1. General information
These Subscription Terms set out the rules for using paid plans of the Whispet application and supplement the App Terms of Service.

2. Available subscription plans
The App offers two subscription plans: the free Free plan and the paid Premium plan (monthly and annual variants).

Plan limits apply to the User's own pets. As a Shared Care participant, the User sees the data shared with them (including weight history) in read-only mode and can export it — regardless of their plan.

Prices include VAT. Actual prices may vary by country and are displayed in the Apple App Store before purchase.
3. Billing period and automatic renewal
3.1. The subscription is billed on a monthly or annual basis, depending on the selected plan.
3.2. The subscription renews automatically for the next billing period, unless cancelled at least 24 hours before the end of the current period.
3.3. The charge for the next period is automatically deducted from the payment method associated with the Apple ID account within 24 hours before the end of the current period.
3.4. Upon purchasing a subscription, any unused portion of a free trial period is forfeited.
4. Payments
4.1. Payments are processed by:
- Apple App Store (iOS/macOS) via Apple In-App Purchase
4.2. The Service Provider does not process or store the user's payment data (card number, bank details). Transactions are handled entirely by Apple Inc.
4.3. Invoices/payment confirmations are available in the Apple App Store purchase history.
5. Cancelling a subscription
5.1. The User may cancel a subscription at any time:
iOS / macOS:
Settings > [Your Name] > Subscriptions > Whispet > Cancel Subscription
5.2. Cancellation means the subscription will not renew for the next period. The User retains access to Premium features until the end of the paid period.
5.3. After the subscription expires:
- The account returns to the Free Plan
- Data is not deleted — it remains on the device
- Excess pet profiles (above the Free Plan limit) are archived (not deleted) — data is preserved and available for viewing
- Premium features (weight tracking, event journals, photo history import, smart pet photo detection) become unavailable. Medical reminders remain available on Free.
6. Plan changes
6.1. The User may change their subscription plan to a higher (upgrade) or lower (downgrade) tier at any time.
6.2. Upgrade: The new plan activates immediately. The price difference is prorated by Apple.
6.3. Downgrade: The new plan activates at the beginning of the next billing period. Until then, the user continues to use the current plan.
6.4. When downgrading, excess pet profiles (above the new plan's limit) are archived. The User may choose which profiles to keep active.
7. Free trial period
7.1. The Service Provider may offer a free trial period for new users.
7.2. If a trial period is available, its duration is displayed on the purchase screen.
7.3. After the trial period ends, the subscription automatically transitions to a paid plan, unless the user cancels before the end of the trial period.
7.4. The rules for granting a free trial period are determined by the Apple App Store for the relevant Apple ID account; in particular, the trial period may be offered once per Apple ID in accordance with Apple's current policy.
7.5. The free trial period is 14 days and applies to the annual variant of the Premium Plan. It is granted once to Users who have not previously held any Whispet subscription; eligibility is determined by Apple at the level of the Apple ID account. Whether the offer is available for a given account is shown on the purchase screen before the payment is confirmed.
7.6. The free trial period is not shared through Family Sharing, even where the subscription itself is shared.
8. Refunds
8.1. Refunds are handled in accordance with:
8.2. To obtain a refund, the user should contact Apple directly. The Service Provider does not process refunds independently.
9. Right of withdrawal
9.1. A User who is a consumer within the meaning of Art. 22¹ of the Polish Civil Code has the right to withdraw from the contract within 14 days of the date of purchase, without giving a reason (Polish Act of 30 May 2014 on Consumer Rights).
9.2. Apple as seller-of-record: a Premium subscription purchased via the App Store is a contract concluded with Apple Distribution International Ltd. (Cork, Ireland — for the EEA) as seller-of-record, not with the Service Provider. Apple processes the payment. To exercise the right of withdrawal, the User should contact Apple (typically via reportaproblem.apple.com) or the address hello@whispet.app — the Service Provider will assist with the process of contacting Apple.
9.3. Exercising withdrawal and cancellation: Apple operates its own refund procedures and provides a subscription-cancellation option in Settings → Apple ID → Subscriptions on the device (a mechanism that satisfies the EU withdrawal/cancellation-button requirement under Directive (EU) 2023/2673 effective 19 June 2026). Refunds are processed exclusively by Apple — the Service Provider has no technical means to refund the payment independently.
10. Price and terms changes
10.1. Subscription prices are managed by Apple via the App Store. The Service Provider reserves the right to request price changes — on the terms set out in sections 10.2–10.3.
Independently of the above, the Service Provider may amend these Terms solely for valid reasons, which are:
a) a change in generally applicable laws or in their official or judicial interpretation, affecting the content of these Terms or the manner in which the service is provided;
b) a court ruling or a decision or recommendation of a competent authority, affecting the content of these Terms;
c) a change in the requirements of the store operator through which the App is distributed (in particular the App Store Review Guidelines and Apple's terms);
d) reasons of App security or of the protection of Users' personal data;
e) technological development of the App — the addition, modification or withdrawal of features — provided that this does not impair the functionalities available to the User under their plan or the services for which the User has already paid.
An amendment to these Terms made for reasons other than those set out above shall not be binding on the User.
10.2. Apple notifies the User of subscription price changes in accordance with the current App Store policy (system notification, Apple ID e-mail, App Store screen).
10.3. In the event of a price increase, Apple may require the User's renewed, informed acceptance of the new price — without that acceptance, the subscription will not renew automatically and will expire at the end of the current billing period.
10.4. Independently of Apple's notifications, the User will be informed of material changes to these Terms via the App at least 14 days before they take effect.
10.5. If an amendment to these Terms adversely affects the User's access to or use of the service — other than to a minor extent only — the User may terminate the contract free of any charge, within 30 days of being informed of the amendment or of the amendment being made, whichever is later (Article 43p(2)–(3) of the Consumer Rights Act). The User cancels the subscription in device Settings → Apple ID → Subscriptions. Where the contract is terminated on this ground, the User is entitled by law to a refund of the proportionate part of the price for the unused billing period; the payout is handled by Apple as seller-of-record, and the Service Provider will give the User the assistance needed to obtain it.
11. Technical limitations
11.1. The App operates in offline-first mode — full functionality is available without an Internet connection. Some features require connectivity: synchronisation with the private iCloud database (Apple CloudKit), Shared Care (via Apple CloudKit), and payments and subscription renewal (Apple App Store).
11.2. Photo and pet limits apply to active profiles — archived profiles do not count towards the limit.
11.3. The Service Provider makes every effort to ensure uninterrupted availability of the service, but does not guarantee 100% availability (see: Terms of Service, section 9).
11.4. The App is a digital service within the meaning of Chapter 5b of the Polish Act of 30 May 2014 on Consumer Rights (transposition of Directive (EU) 2019/770). The Service Provider is obliged to deliver the App in conformity with the contract; in the event of lack of conformity, a User who is a consumer is entitled to the rights conferred ex lege by Art. 43k–43o of the Act on Consumer Rights.
12. Contact and complaints
12.1. Subscription payment refunds are handled by Apple — see §8 above.
12.2. Complaints concerning service operation (e.g. lack of access to Premium features despite an active subscription) may be submitted to:

13. Final provisions
13.1. These Subscription Terms are governed by Polish law.
13.2. Disputes arising from these Subscription Terms shall be resolved in accordance with EULA §13 and Terms of Service §16.1a — the Polish court having jurisdiction over the Service Provider's registered office.
13.3. In matters not regulated herein, the Whispet Terms of Service and applicable laws shall apply.
13.4. These Terms enter into force on 1 March 2026.
